Concurrent Employment & Occasional Lectures and Consultations

In some cases, international scholars can be employed by multiple organizations as long as they follow proper procedures before starting their concurrent employment. Additionally, during their time at Emory, international scholars may be asked by other entities to occasionally consult or lecture. 

There are different immigration rules for different immigration statuses, so it is important that scholars consult their ISSS advisor before accepting any employment or invitations from other entities. 

Concurrent Employment

All J-1 scholars should conduct their activities on Emory's premises, and they should perform only Emory's J-1 activities. J-1 scholars who are interested in working for another institution will need to transfer their SEVIS record to the new institution. 

Occasional Lectures and Consultations

Per federal regulations  J-1 Research Scholars and Professors are eligible to take part in occasional lectures or consultations (up to two per month) as long as they meet the following criteria:

  1. The engagement is related to the scholar's Exchange Program objective. 
  2. Participation in the occasional lecture or consultation will not delay the scholar's program completion. 
  3. The scholar receives written approval from ISSS in advance..

Important

  • This benefit allows J-1 Research Scholars or Professors to deliver a one or two day lecture. Teaching a semester-long course is not appropriate as it is on-going and not occasional. 
  • Scholars must not begin any activities without following the procedures below and receiving written permission from ISSS. 

Procedure:

  1. Get a letter from the inviting institution on official letterhead that includes:
    • Date(s) of the occasional lecture or consultation
    • Number of hours
    • Field or subject area of the activity
    • Amount and type of compensation
    • Detailed description of the activity
       
  2. Send a copy of the invitation letter to the scholar's supervisor.
     
  3. If the supervisor agrees to recommend the activity, the J-1 scholar should log into ISSS Link and fill out the "Occasional Lectures or Consultations" e-form (found under the "J-1 Scholar Services" tab).
    • After the e-form is submitted, the supervisor will receive an email directing them to complete their portion of the request. 
    • Once completed by the supervisor, the request is considered complete and will be reviewed by ISSS within five business days.
       
  4. If the activity is approved by the supervisor and ISSS, ISSS will email the scholar an approval letter. 
    • The J-1 scholar can give this letter to the inviting institution for paperwork purposes.  

Concurrent Employment

Since H-1B, E-3 and O-1 statuses are employer-specific, each employer needs to file an H-1B, E-3 or O-1 petition on an employee's behalf.

H-1B, E-3 and O-1 scholars should consult their ISSS advisor before starting any concurrent employment to make sure they do not violate their non-immigrant status.

Occasional Lectures and Consultations

A scholar's activities in the US are limited to the information provided to DHS when the scholar was granted their current status.  Thus, H-1B, E-3 and O-1 scholars should not accept additional job(s) or duties.  

H-1B, E-3 and O-1 scholars can present at professional conferences and can be reimbursed for travel expenses that they actually incur. In these situations, it is recommended that the scholar keeps receipts for their records. However, H-1B, E-3 and O-1 scholars should not conduct any activities that would normally result receiving in honorariums or payments from other entities. 

Concurrent Employment

TN status is employer-specific. To be employed by multiple institutions, a TN scholar would need to (re)enter the US with a letter from each employer describing their employment. Both employers should be listed on the scholar's I-94. Alternatively, the new employer can file a petition with USCIS for concurrent employment, in which case the scholar will receive an I-797 approval notice for the employment.

TN scholars should consult their ISSS advisor before starting any concurrent employment to make sure they do not violate their non-immigrant status.

Occasional Lectures and Consultations
