Leave of Absence & Withdrawal
Overview
When an international student takes a leave of absence or withdraws from Emory, ISSS is required by US federal regulations to "close" the student's SEVIS record. F-1 and J-1 students are not permitted to remain in the US if withdrawn from school or during a period of leave.
Students planning to unenroll (for any reason) should contact their academic department/program (see "School Contacts" below) for instructions on requesting a leave/withdrawal from the university. They should also reach out to their ISSS advisor. Students must follow ISSS' procedures before the leave of absence/withdrawal is officially recorded by the student's department or school.
Failure to notify ISSS in a timely manner is considered a violation of one's immigration status which can be problematic especially if the student wishes to return to the US in the future. Notifying ISSS in advance may also make the student eligible for certain benefits (e.g. grace period, reactivation of their SEVIS record, etc.).
Study or Research Abroad Student:
Students who are studying abroad through Emory or doing full-time research abroad for their doctoral dissertation do not need to request a leave of absence. However, students should discuss their planned study/research abroad with their ISSS advisor prior to leaving the US to avoid jeopardizing their immigration status.
J-1 Students Only:
The Leave of Absence section on this page contains policies and procedures relevant to F-1 students only. J-1 students interested in taking a leave or withdrawing from Emory must discuss the change with their Responsible Officer (RO) or Alternate Responsible Officer (ARO).
- J-1 students who are sponsored by Emory should contact their ARO/RO (ISSS advisor).
- If a leave/withdrawal is appropriate, the ISSS advisor will direct the student to log into ISSS Link and submit the Leave of Absence form.
- The ISSS advisor will process the request within five business days and notify the student through e-mail.
- J-1 students sponsored by another organization (e.g. Fulbright) should contact their program sponsor.
F-1 Leave of Absence
Before taking a leave of absence, F-1 students should familiarize themselves with the policies and procedures for obtaining an authorized leave of absence and requesting a return from leave. Students should also be aware how the length of time they remain outside the US has an impact on the return from leave process as well as their eligibility for F-1 student benefits upon their return.
- Students must complete the Leave of Absence form in ISSS Link (see "Leave of Absence Procedure" below for more details) prior to the first day of classes or prior to dropping their courses (if taking a leave mid-semester).
- Authorized Early Withdrawal
- By completing the Leave of Absence e-form in a timely manner, ISSS will "close" the student's SEVIS record for the reason of "Authorized Early Withdrawal."
- It is standard procedure and carries no negative consequence on one's immigration record.
- After the SEVIS record is "closed" for the reason of "Authorized Early Withdrawal", the student is given a 15-day grace period to depart the US.
- Students who fail to complete the e-form in a timely manner will have their SEVIS record's terminated for either “Failure to Enroll” or "Unauthorized Withdrawal," which can cause problems in the future when the student plans to return to the US to continue their studies, applies for a new visa and/or requests other US immigration benefits.
More Than Five Months
Students who take a leave of absence and are outside the US for five months or more are required to:
- Be readmitted to Emory
- Provide ISSS with new financial documentation and request a new SEVIS record and I-20 (see "Return from Leave Procedure" below)
- Pay the I-901 SEVIS fee again
- Apply for a new F-1 visa (if applicable)
- Some students need to apply for a new F-1 visa even if their current F-1 visa will be valid at the time they will return to Emory.
- ISSS recommends that students contact their preferred US consulate to determine if they will be required to apply for a new F-1 visa after ISSS has created a new SEVIS record and has issued a new I-20.
- Whether or not a student will need a new F-1 visa is up to the discretion of the consulate where they apply for the visa.
- Be enrolled for another full academic year (one fall term and one spring term) before being eligible for Curricular Practical Training (CPT) or Optional Practical Training (OPT).
- F-1 students who take a leave for five months or more will lose the time they previously accrued toward the practical training requirement.
- Summer term does not count towards the one academic year requirement.
- For example, students who take a fall semester leave must be enrolled full-time in F-1 status for one spring term and the following fall term before they are eligible to apply for CPT or OPT.
- There are limited exceptions to this requirement for graduate students requesting CPT.
Less Than Five Months
Students who take a leave of absence (except for reasons such as an exclusion, probation, conduct matters, etc.) and spend fewer than five months outside the United States (in between full-time enrollment at Emory), may be eligible for a SEVIS record reactivation.
- After the student has been readmitted to Emory, the student's ISSS advisor can submit a reactivation request to the US Department of Homeland Security (DHS).
- DHS processing times vary.
- Students should plan ahead as it can take from several weeks to months for a reactivation to be approved.
- If DHS approves the reactivation, the student does not need to:
- obtain a new SEVIS record and I-20 (unless the student requires an updated travel signature)
- pay the SEVIS I-901 fee again
- obtain a new F-1 visa (unless the current visa will be expired at the time the student returns to the US)
- accrue another full academic year (one fall term and one spring term) before being eligible for practical training.
- Students taking a leave starting fall should carefully read the summer enrollment requirements.
- Even if the student was physically outside the US for less than five months, DHS may still deny a reactivation request if it has been more than five months between the date the student last attended classes and the start date of the next semester when they will resume classes.
- For example:
- A student was enrolled full-time for the spring semester and spends the summer in the US.
- Prior to the start of the fall term, the student determines they need to take a leave of absence.
- The student completes the proper leave of absence procedures and departs the US.
- The student decides to resume their studies in January and requests a reactivation of their SEVIS record, because they have been physically outside the US for less than five months.
- The reactivation is denied because more than five months passed between the last day they were enrolled full-time (previous spring term) and the start of the following spring term.
To officially request a leave of absence from ISSS and be provided with an "Authorized Early Withdrawal" in SEVIS, students must complete the following:
- Log into ISSS Link and submit the Leave of Absence form (located under the General Student Services tab).
- The student's ISSS advisor will review the request within five business days. If the student is eligible for an "Authorized Early Withdrawal," the ISSS advisor will "close" the student's SEVIS record and e-mail the student to notify them.
- After receiving the approval e-mail from their ISSS advisor, the student must:
- Depart the US within 15 days of having their SEVIS record "closed."
- Make sure they do not have any courses scheduled for any current or future semesters.
To return from a leave of absence, students must complete the following:
- Contact their academic department/program (see "School Contacts" below) for readmission instructions.
- Contact their ISSS advisor after readmission.
- Complete the Return from Leave I-20 Request. In the e-form, the student will need to provide the following:
- Passport copy
- Financial Documentation
- The student's ISSS advisor will review the request within five business days and contact the student with any questions.
- If the student is eligible for a reactivation of their "closed" SEVIS record, ISSS will submit a request to DHS.
- If approved by DHS, ISSS will notify the student by e-mail.
- The student may use their most recent I-20 to return to the US.
- If an updated travel signature is required, the student can request one by submitting a Travel Information Update form in ISSS Link.
- If the student requires a new SEVIS record, a new I-20 will be created and e-mailed to the student.
- If the student is eligible for a reactivation of their "closed" SEVIS record, ISSS will submit a request to DHS.
- For students with new SEVIS records only:
- Follow ISSS' Student Pre-Arrival Checklist for information about paying the SEVIS fee, applying for a new visa, and making travel arrangements.
- Note: The student cannot enter the US more than 30 days prior to their new I-20 start date.
- Complete ISSS' Student Post-Arrival Checklist for guidance on completing international student check-in.
- Follow ISSS' Student Pre-Arrival Checklist for information about paying the SEVIS fee, applying for a new visa, and making travel arrangements.

Withdrawing from Emory
Students interested in withdrawing from Emory must notify their academic department/program as well as ISSS in a timely manner. These procedures are outline in the "Overview" section (above). Failure to do so may prevent a student from applying for readmission or may cause US immigration challenges in the future.
There are three types of withdrawals:
For ISSS purposes, a voluntary withdrawal is treated the same as a leave of absence. F-1 students interested in withdrawing should review and follow the regulations, policies, and procedures outlined in the "F-1 Leave of Absence" section (above).
J-1 students interested in withdrawing from Emory must discuss the change with their Responsible Officer (RO) or Alternate Responsible Officer (ARO) (e.g. their international student advisor).
- J-1 students who are sponsored by Emory, should contact their ISSS advisor.
- J-1 students sponsored by another organization (e.g. Fulbright) should contact their program sponsor.
Although rare, students are occasionally terminated from their program for academic reasons. If this occurs, the student must leave the US as soon as they are notified of the termination. A voluntary withdrawal will not be possible. Per the regulations, ISSS must terminate the student's SEVIS record.
Students who are at risk of being terminated from their academic program should discuss their situation with their ISSS advisor as soon as possible. ISSS advisors can help students understand the immigration ramifications and make plans.
Some doctoral students in the Laney Graduate School have the ability to apply for a terminal master's degree if they are leaving their PhD program early. Students interested in applying for a terminal master's should contact their ISSS advisor before the change takes place. If the student is eligible, they will be provided with an updated immigration document and advised on their end of program options (e.g. post-completion employment authorization, SEVIS transfer to attend another institution, departing the US etc.).
